1. Acceptance of Terms
By accessing or using the Plain & Pixel website (plainnpixel.tech) or engaging Plain & Pixel for services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use this site or our services.
2. Services
Plain & Pixel provides growth infrastructure consulting, marketing automation, CRM setup, analytics implementation, and related services for startups and scaling businesses. The specific scope, deliverables, timelines, and pricing for any engagement are agreed in a separate Statement of Work (SOW) signed by both parties.
3. Intellectual Property & Ownership
All work product, code, automations, documentation, and systems built by Plain & Pixel during a paid engagement are transferred in full ownership to the client upon receipt of final payment. Plain & Pixel retains no rights to client-specific deliverables after handover. Plain & Pixel retains ownership of its own methodologies, frameworks, templates, and tools used in the engagement.
4. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during an engagement. Plain & Pixel will not share client data, business metrics, or strategic information with third parties without written consent.
5. Limitation of Liability
Plain & Pixel's total liability for any claim arising from services rendered shall not exceed the total fees paid by the client for the relevant engagement. Plain & Pixel is not liable for indirect, consequential, or incidental damages including lost revenue or business opportunities.
6. Payment Terms
Payment terms are defined in the SOW for each engagement. Plain & Pixel typically operates on a milestone-based payment structure. Work may be paused on engagements with outstanding invoices over 14 days.
7. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or a related engagement shall be subject to the jurisdiction of courts in India.
8. Changes to These Terms
Plain & Pixel reserves the right to update these Terms of Use at any time. Material changes will be communicated to active clients. Continued use of the site after changes constitutes acceptance of the updated terms.
